====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 12-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Muzaffarpur Town P.S. Case No.456 of 2013 registered under Sections 147, 148, 149, 452, 436, 307, 353, 323, 427, 337, 379 and 504 of the Indian Penal Code.

The accusation is that due to rash and negligent driving, a truck dashed the motorcycle in which an women died. Due to that reason, local people and antisocial elements damaged the truck. In the meantime, the police reached there and saw the antisocial elements chasing the driver of the truck with an intention to kill and damaging the truck. Some culprits were committing the loot

Patna High Court Cr.Misc. No.34474 of 2017 (4) dt.12-12-2017 2/2 of the money of the driver of the truck and other materials, kept in the truck. While the police tried to pacify the matter but the antisocial elements burnt the truck. At that time, 15 persons including the petitioner were identified.

Learned counsel for the petitioner submits that, in fact, the petitioner being the resident of the P.O. village was present there and, on mere suspicion, he has falsely been implicated in this case. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No.456 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U
