2. In this case, the petitioner is seeking regular bail in connection with Chandauti P.S. Case No. 439 of 2024, registered for the offences punishable under Sections 61(2) and 62 of the Bharatiya Nyaya Sanhita and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per allegation, during patrolling, three persons apprehended on suspicion who disclosed their names as Md. Talib Khan (petitioner), Sudhir Yadav and Munnawar Khan. On search, one loaded country made pistol and two live cartridges were recovered from the possession of petitioner.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.25821 of 2025(2) dt.02-05-2025 2/2 that for the allegation of recovery of country made pistol and two live cartridges, the petitioner is incarcerating for near about five months.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No. 439 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
