Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Since the court proceeding in physical mode is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

The petitioners, being the parents and brother of the husband of the victim, are apprehending arrest in a case registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.

The prosecution case is that the daughter of the informant, Priti Kumari was married with Krishna Murari in May, 2019 but subsequent to the marriage there was further demand of dowry and for non-fulfillment of the same, torture was inflicted. On 13.01.2020, the husband of the victim informed the informant that Priti Kumari was not in the house, thereafter, search was made and her dead body was recovered from the bush near railway line.

It is submitted by learned counsel for the petitioners that the petitioners are in-laws of the victim and there is no specific overt act against them. It is further submitted that the husband of the victim is in judicial custody. Learned APP submits that the petitioners are named in the FIR.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below
