JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-10-2022 Heard learned counsel for the petitioner and the State. Petitioners seeks pre arrest bail in a case registered for the offence punishable under Sections 307, 379, 380 and some other ancillary Sections of the Indian Penal Code. As per prosecution case, on account of land dispute, this petitioner along with other FIR named accused persons, variously armed, arrived at the house of informant and assaulted him. It is further alleged that this petitioner assaulted the informant by means of sword causing cut injury on his hand and when wife of informant came to save she too was assaulted. It is submitted that petitioner has falsely been implicated in this case. It is further submitted that on account of land dispute simple Mar-pit took place in which informant sustained simple injury. There is case and counter case.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case and clean antecedent of the petitioners, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Minapur PS case No. 458/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
