02. In the present case, the petitioner seeks bail in connection with Ara Mufassil P.S. Case No. 89 of 2024 registered for the alleged offences under Sections 414, 420, 467, 468, 471, 120B of the Indian Penal Code and Section 25(1-b), 26, 35 of the Arms Act.

03. As per prosecution case, police received secret information about miscreants travelling by a stolen truck and they were carrying firearms and ammunition. The said truck was intercepted after chase and out of three miscreants, one was apprehended and two of them fled away. On search of the apprehended co-accused Sumit Kumar, recovery of a country made katta , five live cartridges and six empty cartridges was

Patna High Court CR. MISC. No.27797 of 2025(2) dt.07-05-2025 2/3 made. The mobile of the co-accused and the truck in which he was present was also seized. The apprehended co-accused disclosed the name of the petitioner as one of the persons, who fled away on seeing the police party.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner has been made accused merely on suspicion and the allegations are mostly general and omnibus. There is no recovery of any firearm from this petitioner who is in custody since 27.11.2024. Charge-sheet has been submitted. The petitioner is having antecedent of four cases.

05. Learned APP for the State opposes the prayer for bail. Learned APP submits that the petitioner appears to be a habitual offender and he is accused in serious cases.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the the fact that no recovery has been shown from the petitioner and further considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs.

No.27797 of 2025(2) dt.07-05-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Bhojpur, Ara in connection withAra Mufassil P.S. Case No. 89 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
