The petitioner apprehends his arrest in S.K. Puri P.S. Case No. 191/2015, registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code. The informant a practicing advocate of Patna Civil Court, filed a case making allegation that the petitioner and others took Rs. 5,00,000/- from him for transfer of trade of his son from Information and Technology to Computer Science in M.S. Ramaiya Engineering College, Bangalore.
Learned counsel for the petitioner submits that there is no chit of paper to show that the petitioner ever received any money from the informant. Petitioner has got no business to get admission in any Engineering College. Petitioner runs an institution to impart tuition to the students. Son of the informant was never admitted in the institution of petitioner. Petitioner
Patna High Court Cr.Misc. No.46912 of 2016 (4) dt.10-01-2017 2/2 entered into a compromise vide annexure-2 with Wasif Nisar after receiving Rs. 1,00,000/- from him.
On the other hand, learned counsel for the informant as well as learned A.P.P. vehemently opposed the prayer for anticipatory bail and submitted that petitioner is in the habit of cheating innocent persons. Petitioner has got criminal antecedent and he is also accused in S.K. Puri P.S. Case No. 246/2015 and this fact has not been stated by the petitioner in the bail petition, but it appears that the petitioner has stated in para 3 of the bail petition that one case being S.K. Puri P.S. Case No. 246/2015 is also lodged against him in which he has already been granted anticipatory bail vide order passed in Cr. Misc. 56362/2015.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with S.K. Puri P.S. Case No. 191/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
