JUSTICE SUDHIR SINGH ORAL ORDER 10-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 354/34of the POSCO Act. Allegation against the petitioners is that they made attempt to commit rape upon the informant.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. The alleged occurrence is said to have taken place on 7.5.2015 but the F.I.R. was instituted on 12.5.2015 for which no explanation has been given on behalf of the prosecution. The other co-accused has been granted bail vide Cr. Misc. no. 58151 of 2015.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.58036 of 2015 (2) dt.10-03-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Ist Addl. Sessions Judge, Aurangabad, in connection with Mahila P.S. Case no. 12 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
