JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Session Trial No. 155 of 2020 arising out of Chapra Muffasil P.S. Case No.120 of 2018 for the offence under Section 395 of the Indian Penal Code.

As per the statement made in paragraph 3 of the bail application, 13 criminal cases are pending against the petitioner which are of similar nature.

Considering the aforesaid, the Court is not inclined to grant bail to the petitioner. Prayer for bail is rejected at this stage.

However, the court below is directed to expedite the trial and conclude the same at the earliest preferably within a

Patna High Court CR. MISC. No.23476 of 2020(3) dt.05-02-2021 2/2 period of nine months from the date of receipt/communication of a copy of this order.

Superintendent of Police, Saran at Chapra is directed to ensure the production of all the prosecution witnesses for their examination so that the trial may be concluded within the time frame as indicated hereinabove.

In the event the trial is not concluded within the time frame as indicated hereinabove, the court below shall release the petitioner on bail on appropriate terms and conditions and submit a failure report for not following the observation made hereinabove by this Court before Registrar (Vigilance) of this Court.

The application stands disposed of.
