01-10-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Sheohar P.S. Case No. 87 of 2020 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. It is submitted on behalf of petitioners that there is case and counter case in between the parties and both sides sustained injury. The case lodged from the petitioners' side is earlier in point of time, vide Sheohar P.S. Case No. 83 of 2020 (Annexure - 2). The injury sustained by the informant has been

Patna High Court CR. MISC. No.24483 of 2020(2) dt.01-10-2020 2/2 found to be simple in nature by the doctor, as per injury report annexed as Annexure - 3 to the petition. It is stated in paragraph - 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts and circumstances, the anticipatory bail application of petitioners is allowed. In the event of arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the abovenamed four petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 87 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
