2. The petitioner seeks bail in connection with Sessions Trial No. 232 of 2023 arising out of Bochhan P.S. Case No. 3030 of 2022 dated 10.08.2022 registered for the offence punishable under Sections 302 and 120(B) of the Indian Penal Code.
3. The prosecution case, in short, is that informant's son (deceased) left Banaras for his hometown at about 12:30 pm on 08.08.2022 but he was found dead the next morning in litchi farm of Satyanarayan Sah in the village. It is alleged that petitioner (deceased's wife) along with co-accused have killed the informant's son in the light of their illicit relationship.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

The petitioner is not named in the F.I.R., she has been made accused in this case only on the basis of self-confessional statement of the petitioner. On perusal of the F.I.R. it appears that there is a specific allegation against the co-accused but not against the petitioner. Except the confessional statement of the petitioner nothing incriminating against the petitioner has been found during the investigation. Lastly, it has been submitted that the petitioner is in custody since 21.11.2022, having no criminal antecedent and charge-sheet has been submitted in the case.
5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XVIII, Muzaffarpur in Sessions Trial No. 232 of 2023 in connection with Bochhan P.S.
