Petitioner seeks regular bail in Gandhi Maidan P.S Case No. 448 of 2021 registered for the offence punishable under Section 394 of the Indian Penal Code.

As per allegation, three miscreants entered into the office of the informant, assaulted the informant and took away Rs 57,49,000/- kept in almirah.

The main submissions advanced by learned counsel Shri Tej Narayan Singh appearing for the petitioner are that petitioner is not named in the FIR, his name surfaced in he statement of co-accused during investigation, after his arrest, looted money or any other incriminating article was not

Patna High Court CR. MISC. No.27578 of 2022(3) dt.21-09-2022 2/2 recovered from his possession and he has been languishing in jail since 03.02.2022.

Sri Rajendra Prasad Nat, learned APP appearing for the State has opposed the prayer for bail. Heard both sides and perused the FIR as well as case diary of this case. As per prosecution, allegation is against the informant himself who has been made accused later on after institution of the FIR and case diary goes to show that recovery of alleged looted money was made from possession of coaccused and any part of the looted money was not recovered from the possession of this petitioner and case diary shows that investigation has been completed against the petitioner. Considering these facts as well as above submissions, a lenient approach can be taken in respect of the petitioner. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, XIV, Patna in Gandhi Maidan P.S Case No. 448 of 2021.
