JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 188, 171(F) of the Indian Penal Code and Section 177, 179 of the Motor Vehicle Act.

It is alleged that one Bolero vehicle was found moving on the road having taken beacon light when the driver suggested that the vehicle was being used for ambulance purposes. The petitioner is owner of the vehicle in question. It is submitted by learned counsel for the petitioner that admittedly the petitioner was not there in the vehicle when the beacon light was found being used by the driver, though the same was used for the purposes of using the vehicle as an ambulance.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.56230 of 2015 (2) dt.17-12-2015 2/2 petition that petitioner has no criminal antecedent. Considering the nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Chakiya P.S. Case No. 226 of 2015, pending in the Court of learned Chief Judicial Magistrate, Motihari.

With the observations above, the application stands disposed off.
