2. This application is filed for cancellation of bail by the petitioner. The husband-accused was granted bail in connection with Mahila P.S. Case No.04 of 2017, registered under Sections 498(A), 406, 494/34 IPC and under Sections 3⁄4 of the Dowry Prohibition Act.
3. Learned counsel for the petitioner submits that the bail was granted suppressing the fact that opposite party no.2 was not married with the petitioner Geeta Devi and subsequently he married to another woman.
4. The husband-accused was granted bail considering allegation and submissions as well as the merit of the case and the petitioner being in custody for more than a month. There appears no suppression of fact. There was already allegation in the FIR that the
Patna High Court Cr.Misc. No.38621 of 2017 dt.23-08-2017 2 /2 informant was married in a temple so considering entire facts and circumstances the bail was granted to opposite party no.2 so finding no merit, this application stands dismissed.
