The petitioner apprehends her arrest in a case registered for the offence under Section 304B/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. It is a case of dowry death and petitioner happens to be mother-in-law of the deceased.

It is submitted on behalf of petitioner that thrust of the accusation is against husband of the deceased, who is already in custody and petitioner has been made accused only because she is mother-in-law of deceased. There is general and omnibus allegation.

Learned A.P.P. has vehemently opposed the bail petition and submitted that within one year of marriage, the deceased was done to death for dowry by all the F.I.R. named

Patna High Court CR. MISC. No.27429 of 2022(2) dt.22-09-2022 2/2 accused persons including this petitioner.

However, considering the fact that husband of the deceased is already in custody and there is general and omnibus allegation against petitioner, who is mother-in-law of deceased, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Danapur (Patna) in connection with Naubatpur P.S. Case No. 35 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
