The petitioner apprehends his arrest in Barun P.S. case No. 67 of 2017 for the offences punishable under Section 420, 406 of the Indian Penal Code and under Section 40 of the Bihar Minor Minerals Concession Rules, 1972.
The gist of the allegation is that the petitioner was running a brick kiln without any valid papers. The learned counsel for the petitioner submits that petitioner is owner of Dhiraj Brick Kiln and he was running the brick kiln after depositing required fee and obtaining license from Bihar Minor Mineral Corporation and NOC from Bihar State Pollution Control Board.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.43772 of 2017 (3) dt.04-10-2017 2/2 allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. case No. 67 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
