The petitioner apprehends his arrest in Bhore P.S. case No. 358 of 2018 registered under Section 272, 273, 420 of the IPC and u/s 30(a), 35 and 38 of Bihar Prohibition & Excise Act. Huge quantity of liquor weighing about 1192 liters was recovered from the field of Shanti Kuar of village Sisae and the villagers are said to have disclosed that Ajay Rai, the petitioner, and Situ Mishra had kept the liquor there. The learned counsel for the petitioner submits that the petitioner has got no manner of concern with the liquor. Nothing has been recovered from the conscious possession of the petitioner. The liquor was recovered from the field of Shanti Kuar.

Considering the facts aforesaid and nature of

No.25821 of 2019(2) dt.22-04-2019 2/2 allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act Gopalganj in connection with Bhore P.S. case No. 358 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
