JUSTICE RAKESH KUMAR ORAL ORDER 08-09-2015 At the very outset, learned AC to AAG-8 raises preliminary objection on the point of maintainability of the writ petition. He submits that the present writ petition has been filed against an order passed by Respondent no.2 in Forest Appeal Case no.52 / 2011-12, whereas against the said order, the petitioner is having statutory remedy of revision.
After noticing the objection of learned counsel for the State, learned counsel for the petitioner makes a prayer for disposal of the writ petition, so that the petitioner may avail statutory remedy of revision.
The prayer is allowed.
Patna High Court CWJC No.8671 of 2014 (6) dt.08-09-2015 2/2 The writ petition stands disposed of granting liberty to the petitioner to approach the revisional authority. It goes without saying that if the petitioner files a revision petition before the revisional authority within a period of six weeks from today, the revisional authority may examine the revision on its own merit and decide the same in accordance with law.
