The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 448 and 354 of the Indian Penal Code. Learned counsel for the petitioner submits that genesis of the occurrence is civil dispute and the informant is the cousin sister of the petitioner. Since the matrimonial grandmother of the petitioner had executed will in favour of the petitioner, her family members were angry and petitioner has falsely been implicated in this case. It is next submitted that though there is allegation upon the petitioner of assaulting by sword but the injury is lacerated would which is simple in nature which cannot be caused by the
Patna High Court Cr.Misc. No.37818 of 2016 (2) dt.17-09-2016 2 / 2 sword which has also been stated in the order of the Sessions Judge.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Vidupur P.S. Case No. 147 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
