JUSTICE MADHURESH PRASAD ORAL ORDER 26-06-2023 The petitioner participated in the process of selection undertaken for Civil Courts of Bihar in the year 2016 under Advertisement No. 01 of 2016. He raises a grievance that certain vacancies were existing in the District of Supaul, which were never forwarded or considered in the process of recruitment under Advertisement No. 01 of 2016. Had the Authorities been diligent enough, these vacancies would also have been forwarded, advertised and considered for being filled up.

Considering the submission of the petitioner's counsel, the admitted position that emerges is that the vacancies against which the petitioner is claiming relief were not advertised or considered in the process of selection altogether. The petitioner

Patna High Court CWJC No.8300 of 2019(3) dt.26-06-2023 2/2 has participated in the selection process for the number of vacancies specified, without any objection whatsoever. Now therefore he cannot be permitted to turn around and raise such a grievance.

There being no enforceable right, the writ application is dismissed.

Learned counsel for the petitioner submits that liberty be allowed to the petitioner to participate in any subsequent process of recruitment. The Court would only observe that if the petitioner is otherwise eligible, this order would not come in the way of petitioner's consideration.
