The petitioner apprehends his arrest in Magadh Medical P.S. case No. 138 of 2016 under Section 420 of the Indian Penal Code.

The informant alleged that she is working at Calsoft Lab, Bangalore and her younger brother was studying under the guardianship of Priya Ranjan Kumar @ Gopi, the petitioner, who happens to be her maternal uncle. The parents of the informant died in an accident and Rs. 26,07,048/- was deposited by the LIC in account No. 30982717062 of the SBI, Military Cant branch, Gaya. The petitioner took her ATM and password and withdrew Rs. 13,80,000/- in a very short span of time. The learned counsel for the petitioner submits that petitioner got the house of informant constructed besides other expenses met on the head of education of informant and her younger brother but the informant is denying all the facts. Patna High Court Cr.Misc. No.39253 of 2016 (4) dt.18-10-2016 2/2 submitted that the petitioner is ready to deposit Rs. 13,80,000/- in eight equal installments. On such, the learned counsel for the informant did not raise any objection.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Gaya in Magadh Medical P.S. Case No. 138 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to condition that petitioner shall deposit Rs. 13,80,000/- in eight equal installments, each installment of Rs. 1,72,500/-, in eight months by way of bank draft/ RTGS in the account No. 30982717062 of SBI, Military Cant Branch, Gaya.
