For the Petitioner/s : M/s Satya Prakash Sinha & Sanjay Kumar Pandey, Advocates For the S t a t e : Ms Binita Singh, SC XVIII with Mr Nishant Kumar Jha, AC to SC XVIII =========================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 04-01-2018 Heard counsel for the petitioner and the State. 2 Petitioner's counsel submits that in spite of recommendations made by the Deputy Development Officer, Vastra, Bhagalpur, the Director, Handloom and Silk, Industry Department, Government of Bihar, Patna has still not considered the petitioner's claim for being placed in the clerical cadre and for being granted the pay scale of Rs 4,000-/ to 6,000/- and for placing her initial appointment in the rectified scale. The comprehensive representation, which has been filed by the petitioner on 07.07.2012, is pending before the Director (respondent No 2).

Patna High Court CWJC No.11163 of 2014 dt.04-01-2018 2/2 3 No counter affidavit has been filed by the State in the instant case even though the matter is pending since 2014. 4 Since the issue of entitlement of the petitioner based on the recommendation made by respondent No 3 under letter dated 30.10.2009 is to be considered by the Director (respondent No 2), no useful purpose will be served by keeping the instant case pending. The same is disposed of with the direction to respondent No 2 to dispose of the petitioner's representation dated 07.07.2012 (Annexure 5 of the instant writ petition) by a reasoned and speaking order in accordance with law within a period of eight weeks from the date of receipt/production of a copy of this order.

5 With the aforesaid observation/direction, this writ petition is disposed of.
