====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through Virtual mode.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in a case for the offence registered under Sections 304(B) and 201/34 of the I.P.C. The prosecution story, in brief, is that the accused persons including the petitioner killed the victim due to nonfulfilment of demand of dowry. Earlier bail application of the petitioner was rejected vide Cr. Misc. No. 15646 of 2019 under order dated 16.08.2019 taking into account that the petitioner is the husband of the deceased and the onus is upon him to explain the cause of death

This is second attempt on behalf of the petitioner for grant of bail.

A report was called for from the court below regarding the present stage of the case. It has been reported that out of 05 prosecution witnesses, only 01 prosecution witness has been examined and the trial is likely to be concluded within a period of six months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Sessions Case No. 246/2019, arising out of Khagaria Muffasil P.S. Case No. 526 of 2018, G.R. No. 2132 of 2018, pending in the court of learned F.T.C.-II, Khagaria.

The court below is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of copy of this order. The District Magistrate, Khagaria and the Superintendent of Police, Khagaria are directed to ensure that the prosecution witnesses are produced on the fixed date in the court below so that the trial could be concluded within the
