No counter affidavit has been filed on behalf of the State despite the fact that a copy of the writ petition was served on 3.12.2015 itself.
However, in view of the proposed order, the writ application is being considered without granting further time for filing a counter affidavit.
It appears that the petitioner's application for grant of arms licence was rejected on earlier occasion by the licensing authority which was assailed by filing Appeal No.147/2008 before the
Patna High Court CWJC No.18782 of 2015 dt.04-01-2016 2/2 Commissioner, Patna Division. The appeal along with 31 other appeals was allowed vide Annexure-1 dated 10.01.2012 and the matter was remitted back to the licensing authority for fresh consideration, thereafter, the petitioner received notice to appear before the District Magistrate, Sasaram so that a final decision could be taken. The date of interview was fixed on 26.07.2012 itself. The petitioner claims to have appeared but, thereafter, no decision has been taken as yet by the licensing authority. Having regard to the aforementioned facts and circumstances, this writ application is being disposed of with a direction to the District Magistrate-cum-licensing authority to take a final decision in the matter on its own merit and in accordance with law within a period of eight weeks from the date of receipt/production of a copy of this order.
