The petitioners apprehend arrest in connection with Karakat P.S. Case No. 186 of 2016 registered under Sections 341, 342, 323, 504, 506, 307 and 34 of the I.P.C. pending in the Court of S.D.J.M., Bikramganj, Rohtas.
Submission is that petitioners are quite innocent and have falsely been implicated in this case due to previous enmity. Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioners by contending that petitioners are named in the F.I.R. There is direct allegation of assault against the petitioners and the injuries are also corroborated the prosecution version.
Patna High Court Cr.Misc. No.45382 of 2017 (4) dt.12-12-2017 2/2 Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
However, petitioners are directed to surrender before Trial Court and pray for regular bail. The application of petitioner no. 1 be decided on considering his age.
