JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report but it appears from perusal of the impugned order that looted mobile is said to have been recovered from conscious possession of the petitioner.
Submission on behalf of the petitioner is that written report of the informant goes to show that smartphone J7 Max was looted but the impugned order reveals that Samsung mobile was recovered from possession of the petitioner though IMEI number of both the mobile phones appears to be same. He
Patna High Court CR. MISC. No.24592 of 2019(2) dt.17-04-2019 2/2 further submits that so far as criminal antecedent of the petitioner is concerned, only one case was lodged against the petitioner and he was remanded in the present case from the above stated case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 283 of 2018.
