The petitioner seeks bail in Shahpur P.S. Case No.324 of 2018 registered under Sections 406, 420, 467, 468, 471, 341, 323, 504, 384, 506 and 120B of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by a Bench of this Court vide order dated 08.01.2020 passed in Cr. Misc. No.53921 of 2019. The gist of the allegation is that the petitioner and co-accused Pintu Kumar received Rs.68 lacs from the informant but the petitioner neither executed the sale deed nor returned the money. The petitioner called the informant on the pretext of returning money but forcibly snatched the agreement and torn the same.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.31460 of 2020(2) dt.01-12-2020 2/2 petitioner is in jail since 19.03.2019. The trial has not yet been concluded. The informant has already filed suit for recovery of money. The petitioner also executed a sale deed after receiving money from the informant but the informant himself had bad intention to implicate the petitioner even after getting the registered sale deed executed with regard to some piece of land. Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner is in jail for about one year and nine months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Danapur, Patna in connection with Shahpur P.S. Case No.324 of 2018.
