This application, for grant of anticipatory bail, arises out of Palasi Police Station Case No. 185 of 2017, disclosing offences under Sections 406 and 420 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, happens to be Chairman of Sukhsena PACS, is innocent and has not committed any offence. In fact, the petitioner has delivered all the CMR (rice) in question to the State Food Corporation Ariaria and the Manager, Central Cooperative Bank, Jokihat from where cash credit has been given to the petitioner for purchase of CMR from the farmers, has issued No Objection Certificate in favour of the petitioner,
Patna High Court Cr.Misc. No.21600 of 2018 (2) dt.30-04-2018 which evident from annexure-4. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Araria, in connection with Palasi Police Station Case No. 185 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
