The petitioner has prayed for bail in a case registered for the offence punishable under sections 379, 411/34 of the Indian Penal Code.

As per allegation in the FIR, at the time of patrolling party, police has apprehended four accused persons including the petitioner with stolen items.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is helper of seized Auto bearing registration No. BR01PN5206 and he went to Bairiya Bus Stand to carry the passengers at morning. This case is triable by the court of learned judicial magistrate. Petitioner has got no criminal antecedent and he is languishing in judicial custody since

4.1.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Krishna Nagar P.S. Case No. 4 of 2023.
