2. Petitioner seeks bail who is in custody since 19.06.2025 in connection with Nawada Town P.S. Case No. 657 of 2025, F.I.R. dated 16.06.2025 for the offences punishable under Sections 140(3), 103(1), 238 and 3(5) of the BNS, 2023.

3. According to prosecution case, this petitioner along with co-accused Sadanand Kumar have committed murder of the son of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. It appears from the F.I.R. that the date of occurrence as alleged in the FIR is 14.06.2025 but the present

Patna High Court CR. MISC. No.26126 of 2026(3) dt.08-07-2026 2/3 FIR has been instituted on 16.06.2025 i.e. after delay of two days. He further submits that on the basis of suspicion, coaccused Sadanand Kumar was arrested and he has disclosed that he along with this petitioner have committed murder of the deceased and on the basis of statement of the petitioner and coaccused person, the dead body of the deceased namely, Golu Kumar was recovered. He further submits that except the confessional statement of the co-accused person, nothing has come during investigation which suggest the involvement of the petitioner in the present occurrence.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that on the basis of confessional statement of the petitioner as well as co-accused person, dead body of the deceased was recovered. Apart from that, it appears from the paragraph nos. 30 and 31 of the case diary that the co-accused person was in touch with the deceased. He further submits that the bail application of the co-accused, namely, Sadanand Kumar @ Pamri Kumar has been rejected by this Court vide order dated 26.03.2026 passed in Cr. Misc. No. 20449 of 2026.

6. Considering the aforesaid facts and circumstances of the cases, I am not inclined to enlarge the petitioner on bail in

Patna High Court CR. MISC. No.26126 of 2026(3) dt.08-07-2026 3/3 connection with Nawada Town P.S. Case No. 657 of 2025 pending in the court of learned CJM, Nawada.
