JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Petitioner being wife of the brother-in-law of the deceased is apprehending her arrest in a case registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.
The prosecution case is that the son of the informant was killed by his wife and other in-laws. It is submitted by learned counsel for the petitioner that informant is not the eye witness to the occurrence and only material available on record is the confession of the wife of the deceased before the police and considering the same co-accused Nirmala Devi has been granted bail vide Cr. Misc. No. 14129 of 2015. Considering the aforesaid facts, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today,
Patna High Court Cr.Misc. No.55767 of 2015 (2) dt.09-12-2015 2/2 be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bihar Sharif, Nalanda in connection with Deepnagar P.S. Case No. 304 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
