Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Excise P.S. Case No. 298 of 2023 registered for the offence under Sections 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that there is recovery of 324 liters of liquor and also petitioner has offered to deposit Rs. 25,000/- in Ram Krishna Mission Ashrama, Latu Maharaj Path, Opposite Circuit House, Chhapra, Bihar-841301. The petitioner is from Uttar Pradesh. He has no antecedent and also he is in custody since 22.03.2023.
Patna High Court CR. MISC. No.27296 of 2023(2) dt.15-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody and the clean antecedents of the, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-II, Siwan in connection with Excise Case No. 298 of 2023.
Petitioner's bail bond shall be accepted only after he deposits Rs. 25,000/- in Ram Krishna Mission Ashrama, Latu Maharaj Path, Opposite Circuit House, Chhapra, Bihar-841301 and produces the receipt of the same and after verifying the genuineness of the receipt the petitioner shall be released.
