JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). That for issuance of appropriate writ order or direction of writ in the nature of mandamus commanding the respondents to grant second time bound promotion from 1.11.1995 as allowed by letter no. 1045 dated 30.9.10 (Annexure-1).

(ii). That for issuance of appropriate writ, order or direction of writ in the nature of mandamus commanding the respondents to grant ancillary benefits in connection with grants of second time

Patna High Court CWJC No.23516 of 2013(2) dt.23-06-2023 2/2 bound promotion admissible under Rule to the petitioner."

The learned counsel for the petitioner has submitted that though the petitioner has been granted the benefits of second time bound promotion, by an order dated 30.9.10, however, the actual monetary benefits have not been paid to the petitioner till date.

The learned counsel for the Respondent-State submits that in case the benefits, as aforesaid, have not been paid till date, the same would definitely be paid within a stipulated time frame as prescribed by this Court.

Accordingly, I deem it fit and proper to dispose off the present writ petition with a direction to the District MagistrateCum-Settlement Officer, Saharasa, to ensure payment of monetary benefits, emanating out of the aforesaid order dated 30.9.2010, within a period of four weeks from today, failing which he shall not draw his salary.
