The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused persons are alleged to have committed murder of Rani Kumar (deceased), whose dead-body was recovered in a bamboo garden, and a plastic thin rope was found wrapped in her neck and her feet was also tied with saree. Learned counsel for petitioner submits that petitioner was implicated in this case only on suspicion. Informant is not eye-witness of the occurrence. Petitioner is neither family member nor neighbour of the deceased. Nobody has claimed to have seen petitioner going in the company of the deceased towards the place of occurrence. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 10th, East Champaran at Motihari in connection with Kotwa P.S.
