The petitioner apprehends his arrest in Forest Case No. 52F/2017 for the offences punishable under Section 33, 41, 42 of the Indian Forest Act and under Section 2, 27, 29 & 31 of Wild Life Protection Act.
The learned counsel for the petitioner submits that Sheo Shankar is the complainant, who happens to be Forest Range Officer. The complainant named 10 persons including the petitioner and alleged that they were cutting Sesame trees and the complainant identified the petitioner and others while fleeing away. It is submitted that from perusal of Annexure-2 series, it would appear that petitioner, Mahendra Ram, filed complaint case
Patna High Court Cr.Misc. No.5271 of 2018 (2) dt.09-02-2018 2/2 No. 553 of 2016 against complainant and others, much prior to the present case, and that is why the complainant has falsely implicated the petitioner in many other cases. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Forest Case No. 52 F of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
