JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 18-04-2016 Despite indulgence granted by this Court by order dated 22.12.2015, rejoinder affidavit has not been filed on behalf of the petitioners controverting the averments made in the counteraffidavit filed on behalf of the respondent no. 5 and 6. The learned counsel appearing on behalf of the petitioners submits that despite all his endeavours, he has not been able to contact the petitioners; therefore, no rejoinder affidavit could be filed.

In the aforesaid factual matrices as also the averments made in the counter-affidavit filed on behalf of the respondent no. 5 and 6, after some argument, the learned counsel appearing on behalf of the petitioners seeks permission to withdraw the present writ petition with a liberty to file a fresh writ petition in the same subject matter after bringing on record all the subsequent developments, which might have taken place during the interregnum period, if the grievances of the writ petitioners still subsist.

Permission is accorded.
