JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 22-09-2016 Petitioner files the writ application for a direction upon the respondents to grant him benefit of 2nd time-bound-promotion. The State has made categorical statement in paragraph 4 of the counter affidavit that years ago on 09.07.1993, the concept of grant of second time-bound-promotion was given a go by. This position stands further clarified by the Principal

Patna High Court CWJC No.8868 of 2014 dt.22-09-2016 2/2 Secretary, Department of Education, Government of Bihar, Patna vide his Memo No. 161, dated 28.02.2014, copy of which has been annexed as well.

In view of the above, there is no occasion for any mandamus being issued in favour of the petitioner for grant of 2nd time-bound-promotion. Any other claim is not the issue before this Court at this juncture.

Writ application is dismissed, accordingly.
