The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code.

As per the prosecution case, on information having been received that the accused persons were making preparation for giving effect to an occurrence, on a raid being conducted, while the petitioner was caught, another accused person managed to escape. It is stated that a mobile phone was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedent. He is in custody since 13.3.2021 and charge

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 9 months, the Court directs the petitioner to be enlarged on bail in connection with Chautham P.S. Case no. 57 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria.
