The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 504/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the petitioner sides were making construction in front of their house upon Gair Majarua land adjacent to the land of the informant which was objected by the informant whereupon the accused persons assaulted and abused the informant by calling caste name. It is submitted by learned counsel for the petitioner that from the FIR it appears that the accusation has

Patna High Court Cr.Misc. No.55543 of 2015 (2) dt.08-12-2015 2/2 been levelled in the background of land dispute and there is a counter version of the occurrence. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the his event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Hathua) SC/ST P.S. Case No. 61 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
