The petitioner has preferred this application for grant of regular bail in a case registered u/s 147, 148, 149, 323, 325, 307, 354, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.
As per the prosecution case, while the informant along with her husband and relatives was returning to home the petitioner and co-accused persons armed with weapons started abusing the informant and her relative. The co-accused Ramdev

No.27036 of 2022(3) dt.08-09-2022 2/3 Singh fired on the left chest of the informant's husband, coaccused Bipin Bihari Singh also fired, which hit the informant's grandson Rohit Kumar. All the accused persons further assaulted them by pelting bricks and stones causing fracture injury to the hand of the informant's nephew Siyaram Singh. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is accused in one more criminal case as stated in para 3 of the bail petition. There is general and omnibus allegation against the petitioner. The main allegation of firing is against the co-accused persons. It is further submitted that the injuries are simple in nature. The other co-accused has already been granted bail by a Co-ordinate Bench vide order dated 09.03.2022 passed in Cr. Misc. No.10747/2022. The petitioner is in custody since 26.08.2021.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the injuries are grievous in nature caused by hard and blunt substance. Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.27036 of 2022(3) dt.08-09-2022 3/3 the like amount each to the satisfaction of learned concerned Court below, Bhojpur, Ara, in connection with Udwantnagar P.S. Case No. 75 of 2021.
The application stands allowed.
