2. The petitioner apprehends his arrest in connection with Rajepur P.S. Case No. 265 of 2023 dated 09.11.2023 registered for the offence punishable under Sections 307, 447, 448, 341, 323, 324, 325, 354B, 379, 504, 506 and 34 of the Indian Penal Code.
3. The allegation against this petitioner is that he along with others assaulted the informant and his wife on account of land dispute.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is submitted that the doctor has found the injuries of all the three injured
Patna High Court CR. MISC. No.30094 of 2024(2) dt.20-05-2024 2/2 persons as simple in nature caused by hard and blunt substance. There is delay of two days in lodging of the FIR. The petitioner has clean antecedent.
5. Learned APP has opposed the prayer for bail.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Rajepur P.S. Case No. 265 of 2023 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
7. The application stands allowed.
