02. 06.04.2016 Heard learned counsel for the Petitioner and the State. The Petitioner is apprehending his arrest in Kotwa P.S. Case No. 146 of 2015 registered under Sections 302, 506, 201 and 120(B) of the Indian Penal Code pending before Sri Rajiv Kumar-IV, Judicial Magistrate, 1st Class, Motihari or his successor. The Petitioner was granted anticipatory bail but on condition that an affidavit would be filed on his behalf that he had fair antecedents. However, since there was one other case such an affidavit could not be filed and, thus, he filed second anticipatory bail.

Considering that this is an application for second anticipatory bail which is not maintainable, the application is disposed off with a direction to the Petitioner to appear before the Court below within a period of three weeks from the date of receipt of this order which shall consider the fact that on merits the Petitioner was granted anticipatory bail.
