The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code.
The petitioner is office bearer of O.C.P.L.
Company, a non-banking financial institution. The complainant had deposited money which was not refunded to the complainant. The money was deposited at the persuasion of Barun Kumar Singh who has already been allowed anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.38689 of 2016. Another coaccused Surendra Mishra has been granted anticipatory bail by another coordinate Bench in Cr.Misc.No.16064 of 2016. There is
Patna High Court Cr.Misc. No.44072 of 2016 (4) dt.07-04-2017 no material of direct involvement of this petitioner. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court in connection with Aurangabad (T) P.S. Case No.79 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
