JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-01-2016 Heard counsel for the petitioners and the State. The application seeks modification in condition no.(i) of the order dated 06.11.2015. The petitioners were required to surrender and furnish bail bonds within four weeks. One of the bailors was directed to be own/close family member. It is stated that the entire family members of the petitioners are accused(s) of the case. The petitioners have immediately approached this Court for such modification.
Considering the facts and circumstances of the case, the application is allowed. The condition no.(i) incorporated in the
Patna High Court Cr.Misc. No.56876 of 2015 (2) dt.20-01-2016 2/2 order dated 06.11.2015 passed in Cr. Misc. No. 49233 of 2015 is modified to the extent that in place of own/close family members, it shall be read as relatives/close relatives. Since I have modified the condition no.(i) the time granted under order dated 06.11.2015 to surrender respecting Complaint Case No. 1904 of 2014 pending in the Court of Judicial Magistrate 1st Class, Saran at Chapra (U.T.
