====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 07-05-2025 Heard learned counsel for the petitioners and learned Spl.P.P. for the Vigilance Department.
2. In this present case, the petitioners seek bail in connection with Banka P.S. Case No. 958 of 2016 registered for the offences under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.
3. As per prosecution case, petitioners got employment as a Niyojit Sikshak on the basis of forged documents.
4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Petitioners have produced all the genuine documents at the time of their appointment. But
Patna High Court CR. MISC. No.27976 of 2025(2) dt.07-05-2025 2/3 somehow due to some mix up, they have been made accused in this case. Learned counsel further submits that petitioners are ladies and petitioner no.1 is having a four year old female child whereas petitioner no.2 is widow. Petitioners are in custody since 31.01.2025 and charge-sheet has been submitted. Petitioners are having clean antecedent. Similarly placed coaccused Janki Devi has been granted bail by a Co-ordinate Bench of this Court vide order dated 23.04.2019 passed in Cr. Misc. No. 25189 of 2019 and the case of the petitioners is on exactly similar footing.
5. Learned Spl.P.P. appearing on behalf of Department of Vigilance opposes the submission made on behalf of the petitioners. Learned Sp.P.P. submits that the petitioner did not avail the amnesty scheme which was in vogue when the matter was taken up by a Division Bench of this Court and the Division Bench ordered that those persons who have got the job on the basis of forged documents should resign and they resign in the stipulated time, no action would be taken against them.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that the petitioners are ladies and also considering their clean antecedent along with period of custody and submission
Patna High Court CR. MISC. No.27976 of 2025(2) dt.07-05-2025 3/3 of charge-sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/concerned court in connection with Banka P.S. Case No. 958 of 2016, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
