2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the B.N.S..
3. The prosecution case, in brief, is that on 31.07.2024, while informant, along with his family members, was removing weeds from his land in the meantime, all the F.I.R. named accused persons, including this petitioner, arrived there and assaulted on the head of informant by means of butt of gun. It is further alleged that this petitioner, along with other accused persons, snatched cell phone, watch and gold chain from informant and his family members.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.28099 of 2025(4) dt.23-07-2025 2/2 behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, petitioner has falsely been implicated in this case due to land dispute between the parties. Mother of informant has also filed a case bearing Kasim Bazar P.S. Case No. 230 of 2024 against the informant and others. Injuries allegedly caused by this petitioner has been opined to be simple in nature.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, assaulted informant and others and snatched mobile phone, gold chain and other articles. Petitioner has got 11 criminal antecedents of serious offences.
6. Considering the facts and circumstances of the case, specific and direct nature of accusation and criminal antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
