JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-04-2018 The petitioner by the present writ petition seeks to challenge the rejection slip dated 05.02.2018, whereby and whereunder the respondents have rejected the candidature of the petitioner for the post of Cook on the sole ground that he has failed in height. The petitioner has further prayed for remeasurement of his height by a Board. The short facts of the case are that in the year 2017 on-line applications were invited from male citizens for the post of Constable (Tradesman) in Central Industrial Security Force in the trade of Barber, Boot Maker, Cook, Carpenter etc. The petitioner
Patna High Court CWJC No.7574 of 2018 (2) dt.27-04-2018 2/3 had applied for the post of Ct./Cook and admit card was issued for appearing in the P.S.T./P.E.T. exam. The petitioner had appeared in the physical test on 05.02.2018 and is stated to have passed the running test. However, the petitioner was not declared successful in the height test, leading to the petitioner making an appeal for remeasurement of the height on the same day i.e. on 05.02.2018 before the appellate authority, however, the appellate authority also rejected the case of the petitioner with a remark as "failed in height". The only contention raised on behalf of the petitioner is that the respondents have illegally failed the petitioner in the height test and in case his height is got re-measured by a Board, he is confident that he shall qualify the same.
I have heard the learned counsel for the parties and gone though the materials on record and I find that there is no specific allegation of bias or mala fide against the authorities who had examined the height of the petitioner herein. The conclusion drawn by the original authority as also the appellate authority to the effect that in the height test, the petitioner has failed, cannot be said to be inchoate, casual, perfunctory or vague since there is no material to say so, hence this Court, in exercise of its power of judicial review, cannot either direct for re-measurement of the height of the petitioner by a Board, nor can interfere with the

For the reasons mentioned hereinabove, there is no merit in the present writ petition, hence the same is dismissed. (Mohit Kumar Shah, J) S.Sb/- U
