JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-11-2016 Learned counsel for the petitioner has submitted that Condition No. (i) as mentioned in the order, dated 12.08.2015 passed in Cr. Misc. No. 11197 of 2015 may not be imposed on the petitioner since the total amount said to have been misappropriated leading to registration of Sadar Aurangabad Town P.S. Case No. 81 of 2011, amount has been deposited by the said co-accused Surendra Mishra alias Surendra Kumar Mishra.

Considering the above, the order dated 03.10.2016 is modified to the extent that Condition No.(i) of the order dated 12.08.2015 passed in Cr. Misc. No. 11197 of 2015 shall not apply in the case of the petitioner. However, further conditions shall remain intact.

The time granted to the petitioner for surrendering

before the Court below is extended by two weeks more from today.
