JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-04-2018 The petitioners are apprehending their arrest in connection with Paliganj P.S. Case No. 215 of 2017, registered for offences punishable under Sections 147, 149, 448, 353 and 427 of the Indian Penal Code.
Allegation against the petitioner and others is of entering into the office of Block Development Officer and damaging public property and also abused the informant and ransacked the office. It has been submitted on behalf of the petitioners that petitioners have no role to play in the said occurrence and they have gone to the office in connection with some other work and has falsely been implicated in this case.
Learned counsel for the State opposed the prayer for bail
Patna High Court Cr.Misc. No.21936 of 2018 (3) dt.19-04-2018 2/2 on the ground that there is specific allegation against the petitioners of damaging the public property and creating nuisance in the office as well as ransacking the office of informant. Having heard both sides, considering the facts and circumstances of the case, this is not a fit case for grant of anticipatory bail, the same is accordingly dismissed. However, the petitioner if so desire may surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case.
