Learned counsel for the petitioners undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) (D) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He submits that there is no recovery from the conscious

No.27020 of 2022(2) dt.26-08-2022 2/2 possession of the petitioners rather 800 liters of semi liquid of Mahua and Kishmish and other utensils are said to have recovered from the place of occurrence. He further submits that petitioner no. 1 has three criminal antecedents whereas petitioner no. 2 has one criminal antecedents as stated in para-3 of the bail application.

Considering the facts that the petitioners are the members of syndicate, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Atri P.S. Case No. 410 of 2021.
