2. The petitioner has preferred this application for grant of regular bail in connection with Shashtri Nagar P.S. Case No. 977 of 2024 dated 18.12.2024 registered for the offences punishable u/ss 127(2), 64, 115(2) and 89 of the BNS and section 37 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, the petitioner being in drunken condition is alleged to have assaulted the informant. It is also alleged that three years back, the petitioner had brought the informant and kept her locked for one and a half years in the house and sexually assaulted and made physical relationship with her. It is further alleged that the petitioner forcefully got

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that during the investigation, the statement of father of the informant was recorded, who has stated inter alia that about 3 years back his daughter left the house without informing anyone and did not return, and for the same he had given information to sonepur police and suddenly on 18.12.2024 he received a call from shastrinagar police station regarding his daughter and when he went he was allegedly informed by his daughter that petitioner had promised to get her educated and marry her on which she went along with him and started living in Patna.
It is further submitted that the informant, who is a major lady, alleged that the said occurrence started taking place three years prior from the date of institution of the FIR i.e. 18.12.2024, but no information whatsoever was given to any authority and only after three years the present case is being instituted. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Shashtri Nagar P.S. Case No. 977 of 2024.
7. The application stands allowed.
